In the text that follows, the terms “Drawn to the Camino”, “we”, “us” and “our” refer to Drawn to the Camino LLC, a specialized travel company offering guided tours of Spain. The terms "you", “your” and “traveler” refer to the person booking travel with us.

CONTRACT

We draw your attention to the Terms and Conditions of travel below. These terms and conditions including our Terms of Use, Tour Participant Agreement, and the Terms and Conditions of our suppliers form the basis of the contract with you. Before making a booking with us you must ensure that you have read and understood these terms and conditions (raising any questions you may have with us).

Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all the terms and conditions laid out below and acknowledging that you have read the terms of this contract and agree with it.

If you are making a booking for a group of travelers, you are responsible for sharing these Terms and Conditions with all members of the group that you are financially responsible for the booking. We will not be liable for your failure to share these Terms and Conditions with all travelers in your group. You represent and warrant that (a) you are of sufficient age to use our services and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you and the members of your group (if any) is true and correct.

VIOLATIONS BY YOU

You agree that any violation of these terms and conditions may result in (a) the cancellation of your booking or purchase, (b) your forfeiture of any monies paid for your booking or purchase, and (c) you being denied access to the applicable travel related product or service.

CHANGES TO THESE TERMS AND CONDITIONS

The term “Website” refers to our website located at the url https://www.drawntothecamino.com including all pages in that domain. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes on our website at https://www.drawntothecamino.com, which will be effective immediately on posting. If we make material changes, we will notify you. It is your responsibility to check our Website periodically for changes. Your continued use of our services, including continuing to use and maintain any booking following the posting of any changes to the Terms and Conditions constitutes your consent to these changes.

TYPE OF TOUR

GUIDED TOURS: Our Guided Tours depart only a limited number of times during the year on specific dates (fixed departure) that we advertise on our Website and/or marketing materials. These Guided Tours are designed for individual travelers that want to meet new people and travel with the comfort and convenience that comes with being part of a guided group. It is a great way to make your tour experience even more memorable.

WHAT IS INCLUDED IN YOUR TOUR

All tours are LAND ONLY tours. They do NOT include airfare and do NOT include transportation to the designated meeting point or from the designated end point of your tour.

GUIDED TOURS: Guided Tours include the following:

  1. ITINERARY. Complete itinerary for the designated group tour.

  2. ACCOMMODATIONS. Shared accommodations are included. Due to changing availability and seasonal effects, your specific accommodations will be confirmed in your final travel documents. If a change becomes necessary for any reason, the accommodations substituted will be reasonably equivalent to those shown.

  3. MEAL. Daily Group Dinner.

  4. TRANSFERS ON ITINERARY. All transfers specifically labeled as “included” on your itinerary are included on your tour. Please review your itinerary to confirm included transfers. These transfers are reserved on your behalf on public transportation for the benefit of the individual and under the terms and conditions of those providers.

  5. EXPERT GUIDE. A guide will accompany your tour group to help you along the way. All guides speak both English and Spanish and are available to respond to your needs on the spot. They will teach you the local culture, share their insights on El Camino and be your point of contact for all your tour-related needs.

  6. ART, ART HISTORY, CULTURAL HISTORY AND MINDFULNESS TRAINING. Our guides will provide unique instruction on the history, culture and unique architecture that will be encountered on your tour. Art instruction—sketchbook/journalling and several group practice opportunities will be incorporated into the daily practice of the walk.

  7. OTHER INCLUSIONS. In addition to the items listed above, your tour includes some additional experiential opportunities— local pintxo tour; museum, castles and cathedrals visits; 3 virtual preparatory meetings; one on one support for preparation as needed; a welcome packet with training tips and trip guidelines and information, 24/7 Emergency Support by phone and a Pilgrim’s credential.

For Additional Cost:

To customize the experience for the different fitness levels of our participants, we are able to offer additional services in advance of departure such as luggage transfer for an additional cost. These too are reserve for the benefit and on behalf of the participant and pricing is determined by the amount of service utilized, VAT plus service fee.

BOOKING AND PAYING FOR A TOUR

Guided Tours with fixed itinerary, inclusions and price advertised on our Website can be booked directly through our Website.

DEPOSIT. A non-refundable deposit (“Deposit”) of 15% of the cost of the tour at the time of booking is required to formalize each booking request. Upon payment of your Deposit, we will confirm your booking. If there is no availability for your dates, your booking request will be declined, and your Deposit will be returned to you. If there is availability, your booking will be confirmed by us.

After your booking is confirmed, you will receive your itinerary, an invoice and other important travel information. The invoice will contain a breakdown of the elements of your booking and will have your Deposit applied towards your balance. Invoices must be paid in full no later than 90 days before your tour start date.

If you are making a booking for a tour within 90 days of the tour start date you must pay the full balance at the time of booking. If full payment is not received when due, we reserve the right to consider your booking cancelled. In such a case, this would be considered a cancellation by you and cancellation fees will apply as described in the Cancellation Policy section below.

Once payment in full for your trip is processed, you will receive i) a receipt and ii) your final travel documents, including your Tour Participation Agreement / Waiver of Liability for signature. Please review all documents carefully and promptly as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible of any errors.

REQUIRED DOCUMENTS AND SIGNATURES. As a condition to participating on the designated tour(s) and the completion of Booking, each participant must agree to, and sign, the Registration Form and provide or complete any other required information such as International Health Insurance certificate, Health and Fitness/Medical Forms.

All travelers in your booking must sign the Tour Participation Agreement / Waiver of Liability and Medical Questionnaire 1 week from date of full payment. If any of the travelers in your booking have not signed by this date, we reserve the right to consider your booking cancelled. In such a case, your booking will be considered to have been cancelled by you and cancellation fees will apply as per the Cancellation Policy. RIGHT TO LIMIT SALES AND PARTICIPATION. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to refuse any order or booking that you place with us. We also reserve the right to decline to accept or retain you as a participant in any of our tours if we deem, in our sole discretion, that accepting or retaining you would be detrimental to the tour.

PAYMENT METHODS. We accept major credit cards, ACH transfers and Wire Transfers for payment. A non-refundable $30 fee will be charged for all returned payments.

CREDIT CARD PAYMENTS. While we do accept major credit cards including Visa, Mastercard, and American Express, travelers must provide to us a click or signed authorization for every transaction. Your authorization is an agreement with us to charge your card and an acknowledgement and agreement to these Terms and Conditions including the Cancellation Policy. Any refunds issued via credit card do not include fees paid.

In certain cases, you have the ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask that you first call us to discuss any questions or concerns about our charges. We will work with you to resolve your concerns. Drawn to the Camino retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel booking related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any of the following chargebacks:

  • Chargebacks resulting from non-cancellable bookings, whether the booking is used or not.

  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.

  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.

  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Drawn to the Camino or a Supplier.

  • Chargebacks for charges resulting from Cancellation fees resulting from our application of the Cancellation policy.

PRICE AND RATE CHANGES. Tour Prices advertised on our Website and promotional materials are per person and based on shared occupancy, unless indicated otherwise. All prices we advertise are accurate as of the date of publication, but we reserve the right to change any of those prices from time to time. Prices include local taxes that are estimated at the date of publication. We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed. We will advise you of any errors of which we are aware and of the applicable price at the time of booking.

If our costs to supply your travel increases, we reserve the right to increase the price of your travel and will forward a new invoice reflecting any changes made. After full and final payment your price is locked in.

EXCLUSIONS. Any items, services and matters not referred to in your itinerary specifically as “included” are not included in the price. These include, but is not limited to, passport and visa fees; trip protection and/or insurances of all kinds; gratuities if not listed on your itinerary; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the holiday/vacation whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.

CHANGING YOUR TOUR BOOKING. Tour participation is not transferable. You may not assign your booking to another traveler.

You can request to reschedule your Tour booking once for a later departure date during the same calendar year (subject to availability), provided that you send us a booking change request at least 90 days before your current tour departure date.

Booking change requests must be submitted in writing by email or certified mail. The booking change request date is the date we acknowledge receipt of your email or your mail postmark, respectively.
Booking change requests are not subject to a fee, but are subject to availability of the new dates and services requested and your acceptance of the price for the change to the new dates and services. If there is no availability or you choose not to accept this new price, your booking change request will be denied.

Booking change requests outside the scenarios discussed in this section will be denied.

If your booking change request is denied and you are unable or unwilling to travel on your already booked tour dates, you will have to request to cancel your booking.

Booking cancellation requests are not considered booking change requests and are subject to the cancellation fees shown in the Cancellation Policy section.

MEDICAL QUESTIONNAIRE. It is a condition of booking with Drawn to the Camino that you complete and provide us with a fully completed Travel Booking Form including Medical Questionnaire. All customers must possess physical and mental fitness well enough to travel on the Tour they are booking onto and are required to familiarise themselves with any health requirements specific to the countries being visited. Customers with a pre-existing medical condition that affects their fitness to travel, or any medical/dietary requirements must disclose such conditions or requirements to Drawn to the Camino when booking their Tour and may be required to provide written confirmation from their doctor that they are fit to travel when requested. It is the client’s sole responsibility to ensure that they have had all necessary inoculations, immunisations required prior to departure. All customers should visit their doctor to confirm that they are physically able to undertake the day-to-day requirements of the Tour prior to booking. Should any ailments either exist at the time of booking, or arise before their departure, the customer must inform Drawn to the Camino of these in writing. No liability shall attach to Drawn to the Camino for the provision of an unsuitable trip for persons unfit for travel where disclosure of related physical or medical conditions have not been made directly.

ITINERARY CHANGES. The itinerary provided represents what we have planned for your tour, but it is subject to confirmation and changes in local schedules. We commit to making our best effort so that itineraries are followed as planned. However, it is possible that traffic conditions, weather, holidays, facilities opening hours, construction or circumstances outside our control interfere with the regular schedule, causing itineraries to be modified. We reserve the right to modify the itinerary at our sole discretion and you will not be entitled to compensation for these changes.

CANCELLATION POLICY

CANCELLATION BY TRAVELLER

Drawn to the Camino’s cancellation policy is in effect upon your first payment toward any tour. Cancellation requests must be submitted in writing by email or certified mail at info@drawntothecamino.com and are effective on the date your email was acknowledged as received by us or your mail postmark, respectively. Cancellations are subject to cancellation fees based on the date your cancellation is effective. Cancellation fees for Tours are shown on the respective sections below and are expressed as a percentage of the total price of the tour you purchased.

CANCELLATION FEES FOR GUIDED TOURS

If you cancel more than 90 days before the trip start date, your deposit will become a credit for future travel, minus unrecoverable costs. All other monies paid (balance payments) will be refunded per the chart below. If you choose not to resume a trip with us, deposits will be forfeited.

If you cancel within 90 days of the trip’s departure date, all payments (deposit and balance payments) will be forfeited with no possibility of refund or transfer credits. Upon request, we can issue an official letter that you can forward to your travel cancellation insurance provider for your personal use towards any additional claims.

No refunds will be issued due to late arrival, early departure, removal from trip, or any unused portion of a tour. The Assumption of Risk / Liability Waiver form must be signed and received 60 days prior to tour departure, or the reservation will also be treated as a cancellation. Cancellation fees are outlined below:

TIME / PRICE

Cancel 121 or more days prior to trip start / 10% of trip price

Cancel 120 - 90 days prior to trip start. / 50% of trip price

Cancel 90 days or less prior to trip start. / 100% of trip price

For train ticket reservations, once train tickets are issued, they are non-refundable, independently of the time when you submit the cancellation request. Transfers are also non-refundable if you do not show up or fail to make the set departure time.

We are not able to waive cancellation fees for any reason.

CANCELLATION BY US

We reserve the right to cancel any Guided Tour because of inadequate enrollment that makes the trip economically infeasible to operate or because of our concerns with respect to the safety, health or welfare of our travelers or staff. In case of inadequate enrollment, we will notify you of your tour’s cancellation at least 90 days prior to your tour departure date.

If we cancel a Guided Tour, our liability is limited to a full refund of your payments to us. If a Tour in progress must be interrupted or canceled, our liability shall be strictly limited to refund of the recoverable cost of any unused portion of the Tour. If we cancel a Guided tour, we will not be liable for losses or fees that you may incur by having to reschedule or cancel travel arrangements that you purchased outside the tour itself, such as fees, travel insurance, airline or other transportation tickets. For this reason, we strongly recommend that you wait until 90 days before your Guided Tour departure date to buy your airline tickets and making other related travel arrangements.

In addition, Drawn to the Camino has sole discretion to cancel the tour if the minimum tour participant requirement is not met.

INSURANCE

International Medical Insurance

Travelers are required to have valid international medical insurance on prior to departure, with a minimum of $ 200,000.00 USD evacuation and repatriation coverage, including personal injury and all forms of medical expense. Some trips may have higher minimum medical coverage requirements, which are set out on the DTTC website trip page. Proof of insurance coverage for DTTC is due 1 week before travel. Failure to do so will result in cancellation of participation and forfeiture of any payments and deposit.

Travel and Personal Insurance: Drawn to the Camino strongly recommends you to purchase travel insurance with additional “cancel for any reason” coverage. Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase.

Travel insurance minimizes your risk exposure for the before and for the duration of your travel—not just whether your plane leaves on time or whether your luggage gets lost but if you need to cancel. Most good insurance will cover some or all of the costs associated with COVID-19, theft, lost or delayed luggage, and accidents and emergencies (including emergency extraction and repatriation) when you are traveling.

Declining to purchase an adequate travel protection plan could result in the loss of your travel investment and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.

Drawn to the Camino is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Drawn to the Camino cannot evaluate the adequacy of the prospective insured's existing insurance coverage. If you have any questions about your travel protection, please call your insurer or insurance agent or broker. For your convenience, we able to offer a list of adventure tourism and international medical insurance providers to point you into a direction.

DESTINATIONS AND DOCUMENTATION

You are responsible for ensuring that you meet foreign entry requirements and that your travel documents, such as passports, visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements including inoculations are met. You must consult the relevant Embassy or Consulate for this information before booking and departure, as requirements may change. Your name on your travel documents must match exactly the name shown on your airline tickets and booking.

U.S. citizens traveling to any destination outside of the United States will be required to present a valid U.S. passport. Drawn to the Camino strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation.

We expressly deny any responsibility for any losses incurred if you are refused boarding onto a flight or entry into any country due to your failure to carry the correct and adequate travel documents required by any airline, authority, or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.

Travel to certain destinations may involve greater risk than others. We urge customers to review travel prohibitions, warnings and advisories issued by the relevant governments prior to booking travel to international destinations. In the US, we recommend contacting the Travel Warnings Section of the State Department at (202) 647-5225 or www.travel.state.gov. For medical information and health advisories related to travel we recommend contacting the Centers for Disease Control (CDC) at (877) FYI-TRIP or www.cdc.gov/travel. We cannot change our Cancelation Policy or Terms and Conditions based on warnings or advisories from government agencies, or the occurrence of any terror, health or other incident in one or more of the places that this tour is scheduled to visit. Cancellation fees will remain in effect under these scenarios.

In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID-19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. It is your responsibility to be aware of any and all requirements for admittance to a country or state, including COVID-19 requirements. Drawn to the Camino strongly recommends travelers to be up to date on their Covid-19 boosters to provide the added security for group travel. Should you choose to travel to a country that has been issued a travel warning or advisory, Drawn to the Camino will not be liable for damages or losses that result from travel to such destinations.

Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.

You acknowledge that any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss flight(s), and/or your tour. Drawn to the Camino bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your booking related to improper documentation or government decisions about entry.

HEALTH AND FITNESS

Our tours are active tours and require that you are in good health and good physical condition. You will be walking for several hours each day during several days, so you should discuss with your doctor to see if the tour you have chosen is appropriate for you.

Travelers with Special Medical Conditions or Disabilities: Our walking tours are likely to be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our tours. Prior to booking you must advise us in writing of any physical, emotional, or mental condition which may require special assistance/ equipment or professional attention during the tour, so that we can assist you in considering the suitability of the arrangements and/or in making the booking. If you fail to disclose any such conditions and we find out on our own, we may refuse to allow you to participate in the tour and you will not be entitled to a refund. If you have a special condition or disability, you must bring and be responsible for all necessary items related to your condition, including bringing a paying capable companion traveler willing to assist you. If any such condition arises after the trip is booked, you must advise us in writing immediately. Failure to advise us shall release us from any liability related to such condition.

Our tours involve international travel to foreign countries that have different accessibility standards than those required by United States law. Transportation services and lodging are operated by Suppliers and may not be compliant with accessibility standards such as the Americans with Disabilities Act (ADA). Facilities to accommodate travelers with special needs are lacking in the rural environments where our tours take place. For these reasons, we regret that we cannot provide individual assistance to travelers with mobility challenges or that are not completely independent on their own. Drawn to the Camino will communicate requests to Suppliers but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Drawn to the Camino assumes no responsibility for your inability to participate in the tour or provide any refunds for non-participation in any part of the tour.

TRAINING ACTIVITIES

Any training activities which you participate in, as outlined and recommended by Drawn to the Camino is at your own risk. These are recommended as part of certain Tours, in order to assist participants in preparing for such Tours. We recommend that you immediately visit your Doctor to determine if you have any health issues and/or required fitness levels to undertake the travel activities and/or training activities.

DRUGS AND ALCOHOL

Drawn to the Camino is committed to putting your safety and well-being at the forefront. For this reason, smoking is not permitted near DTTC group participants, during our activities or near the entrances of our accommodations. Smoking is otherwise permitted following local laws and regulations.

We encourage the responsible use of alcohol when it is permitted. Factors such as location, accommodation types, local outfitter policies, activities, cultural traditions will determine when it is acceptable. For example: alcohol is tolerated when we visit local restaurants and licensed establishments. If your guide thinks that you are not in the appropriate condition to undertake an activity due to intoxication or whose conduct detracts from DTTC's ability to conduct business with local providers including but not limited to albergues, for any reason, they have the right to decline a client’s participation and may result in removal. The use of illegal substances are not permitted and any use of these will result in the termination of your trip at client own expense, without refund.

COVID-19, VACCINATION TESTING AND PROTOCOL.

Proof of COVID-19 vaccination may be required by the destination in which the trip is taking place to participate in any trip. COVID-19 testing may also be required by destination countries and/or the trip supplier in order to ensure the safety of the group, and the cost of any testing is the responsibility of the Client. Drawn to the Camino strongly suggests that all participants be up to date on all boosters and have secured their latest booster no sooner than 2 weeks before travel. Having a strong immune response will ensure quick resolution of symptoms should they occur on your journey.

COVID-19 PROTOCOL

Travelers will immediately advise DTTC if they have any symptoms of COVID-19 within 2 weeks of the start of a trip and may be required to provide a negative test or may not be permitted to participate in the trip. If symptoms occur during the trip, you will advise the guide(s) and follow all instructions given to them by the guide(s), including: keeping 2 meters from guides and others on the trip; wearing a mask; and strict isolation until they present a negative test or when symptoms significantly improve.

Travelers with a positive COVID-19 test result may be required to refrain from further group activities and follow local health protocols, based on conversations with your guides, your group and local partners and suppliers. The trip will continue as planned for those who test negative, potentially with modifications (i.e. masking, isolation and social distancing). Reintroduction of those who test positive will be managed on a case-by-case basis and at the sole discretion of group leaders. Anyone failing to adhere to the recommendation of group leaders will be removed from the program.

Any costs associated with testing, isolation, cancellations, delays or medical needs are solely the responsibility of the participant. We strongly recommend all travelers purchase COVID, cancellation and interruption travel insurance coverage, where possible.

If you have any symptoms or is diagnosed with COVID-19 anytime during the 3 days after the completion of the trip, you will email Drawn to the Camino: info@drawntothecamino.com so that we can notify others on the trip.

USE OF PERSONAL INFORMATION

Your submission of personal information is governed by our Privacy Policy. You can access our Privacy Policy at the following url: http://www.drawntothecamino.com/privacy-terms-of-use.

PHOTOGRAPHY and VIDEO

You agree to grant us (and any third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid-up license to use photographs and video of you obtained during the tour by us, solely for our promotional and/or commercial purposes in printed and electronic media. You release Drawn to the Camino and its representatives from any liability in connection with any use of such photographs and/or video.

LIMITATION OF LIABILITY

Please read this Agreement carefully. You must initial and sign this Agreement to participate in the tour. By signing this waiver, you agree to the terms and conditions written below.

Drawn to the Camino, and its employees, shareholders, agents, and representatives use third party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to our Tours. Drawn to the Camino is an independent contractor and is not an employee, agent, or representative of any of these suppliers. Drawn to the Camino does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. Carriers, hotels and other suppliers providing travel or other services as part of the tours are independent contractors and not agents or employees of Drawn to the Camino. Therefore, Drawn to the Camino expressly disclaims any and all liability for any personal injury, death, property damage, loss of baggage, accident, delay or irregularity, any claim for special or consequential damages, or any other loss that may be occasioned by the acts and/or omissions, whether negligent, wrongful or intentional of any such supplier including but not exclusively air carriers, hotels/motels or other lodging operators, railroad operators, bus operators, public transportation companies, local sightseeing companies, tour operators, tour directors (“Guides”) and any employees thereof that are not under the direct supervision and control of Drawn to the Camino when engaged in conveying the traveler or in carrying out the arrangements of the tour, or otherwise in connection therewith. Group administrators and tour directors also expressly disclaim any liability for the acts and/or omissions of any of the above entities or individuals not directly under their supervision or control. We also expressly disclaim liability for a supplier’s failure to perform, intent to cancel or for supplier bankruptcy or insolvency. Be advised that the liability of carriers, hotels and accommodation providers is also limited by law, and you may want to consider purchasing Travel protection to protect yourself against any losses of injuries suffered as a result of their acts or omissions.

Drawn to the Camino assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Drawn to the Camino that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by Drawn to the Camino.


Drawn to the Camino likewise disclaims any liability for statements, actions, inactions of any intermediary agents such as group administrators, tour directors, travel agents or any other intermediary involved with the selling, promotion and operation of the Tours.

Drawn to the Camino disclaims all liability for errors related to the information about air, hotel, car, tours and all other travel products and services on the Website, brochures and any other promotional information and documentation including, without limitation, the pricing and descriptions of the products. We reserve the right to correct any errors on our Website, brochures, promotional documentation and existing bookings at any time, without notice and at our sole discretion. Should we find a pricing error on an existing booking of yours, you will be given the opportunity to cancel it without penalty before we update it to reflect the correct price.

In no case shall Drawn to the Camino LLC, our members, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Website or any of the service or products procured through the Website, or for any other claim related in any way to your use of the Website or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Website or any content (or product) posted, transmitted, or otherwise made available via the Website or our promotional documentation, even if advised of their possibility.

If despite the limitation in this section, Drawn to the Camino LLC or our suppliers are found liable for any loss or damage arising from the above causes, then the liability of Drawn to the Camino LLC and/or our suppliers will in no event exceed in the aggregate the greater of (a) the fees you paid to Drawn to the Camino in connection with the products and services or (b) One Hundred Dollars (US$100.00).

ASSUMPTION OF RISK / WAIVER OF LIABILITY

You are aware that travel in in other nations is not like travel in the United States. Travel in more remote areas of the world, such as the areas as where our Tours take place, involve inherent risks. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicle collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Drawn to the Camino and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical exertion for which you are not prepared or aggravate pre-existing physical injuries, conditions, symptoms, or congenital defects or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided. You have been advised to seek medical advice if you know or suspect that my physical condition may be incompatible with tour activities and have informed the Drawn to the Camino of any known pre-existing medical conditions via Medical Questionnaire.

You understand that the description of these risks is not complete and that unknown or unanticipated risks may result in personal injury, emotional trauma, illness, disfigurement or even death. In order to book travel with us and participate in our Tours, you are willing to accept the risks and uncertainty involved as an integral part of travel, including the risk of personal injury, emotional trauma, illness, disfigurement or even death. Understanding the risks described in this document, you agree, and your family, heirs, and legal representatives hereby accept, to assume full responsibility for any and all risks and agree to and shall hold harmless and fully release Drawn to the Camino from any and all claims associated with the trip, including, but not limited to any claims arising in any way from any injury, death, loss or harm (whether foreseen or unforeseen) third-party negligence and/or the negligence of Drawn to the Camino, that occur to you or to any other person or to property during a Tour or are in any way related to a Tour. You hereby covenant not to sue Drawn to the Camino for any such claims or join any lawsuit or action against Drawn to the Camino. This agreement also binds your heirs, family, legal representatives, and assigns.

You acknowledge that you are not nor will be under the influence of illegal drugs or alcohol while participating in these Activities, some exceptions may apply in regards to alcohol when deemed appropriate by the Operator. Factors such as location, accommodation types, local outfitter policies, activities, cultural traditions will determine when it is acceptable. If your guide thinks that you are not inthe appropriate condition to undertake an activity due to intoxication, for any reason, they have the right to decline your participation. The use of illegal substances are not permitted and any use of these will result in the termination of the trip at client own expense, without refund. It is your responsibility to be aware of local drug laws prior to travel.

You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination and all safety or security conditions at such destinations. For information concerning possible dangers at an international destination, contact the government office in your country that is responsible for issuing travel advisories. In the U.S., contact the Travel Advisory Section of the U.S. State Department, 1-888-407-4747,http://www.travel.state.gov/. For medical information, contact the U.S. Centers for Disease Control (CDC), 800-232-4636,http://wwwnc.cdc.gov/travel/, or the responsible government agency in your country.

You agree that this release shall be legally binding upon you personally, all members of your family and all minors traveling with you, your and their heirs, successors, assigns, and legal representatives, as it is your intention to fully assume all the risks associated with this Tour and to release Drawn to the Camino, their agents, employees, managers, members, suppliers, operators from any and all liabilities to the maximum extent permitted by law. The terms of this ASSUMPTION OF RISK / WAIVER section shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

COVID 19 RELEASE OF LIABILITY

By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by Drawn to the Camino.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to be vaccinated. You are responsible for understanding these requirements and must not rely on Drawn to the Camino to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID-19, Drawn to the Camino has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Drawn to the Camino shall not be liable to any losses howsoever arising.

You, for yourself and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (“Releasors”), HEREBY RELEASE, AND HOLD HARMLESS Drawn to the Camino, its members, officers, agents, and/or employees, suppliers, and other tour members (“Releasees”), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

MISCELLANEOUS MATTERS

You understand that DRAWN TO THE CAMINO has the right to refuse as a trip participant, or remove from a trip, any person a) who it judges to be incapable of meeting the rigors and requirements of participating in the trip activities; b) who it determines to detract fromthers’ enjoyment of the trip or renders themselves or the group unsafe, or c) for not executing this or other required pre-tour documents.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Drawn to the Camino LLC and our subsidiaries, affiliates, partners, officers, members, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any expenses, losses, liabilities, damages, judgments, settlements and costs involved with or incurred by Drawn to the Camino (including without limitation reasonable attorney’s fees and the advancement of same) with respect to any claims, lawsuits, arbitrations or other causes of action which result, directly or indirectly from (i) your breach or violation, or threatened breach or violation, of this agreement and (ii) any damages caused by you while participating in a tour.

SEVERABILITY

In the event that any provision of this Agreement is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from this Agreement. Such determination shall not affect the validity and right to enforce any of the remaining provisions.

ENTIRE AGREEMENT

These Terms and Conditions, together with the Tour Participation Agreement and the Terms of Use constitute the entire agreement and understanding between you and Drawn to the Camino, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us, including, but not limited to, any prior versions of these Terms and Conditions. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial, arbitration or any other administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Failure by us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

BINDING ARBITRATION

We are committed to excellence in dealing with our customers so we will try to address your concerns in case any problems arise. You agree to give us the opportunity to resolve any dispute related to the Website, our customer service agents or our products and services (“Claims”) by contacting us at (215) 740-1908. Claims related to an already completed tour should be submitted within 30 days of the tour completion date so that we may investigate them promptly. If we are unable to resolve your Claims within 30 days of your submission you may seek relief through arbitration or in small claims court, as set forth below.

Any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert a Claim on an individual basis in small claims court if they qualify. This includes any Claims you assert against us, travel suppliers or any companies offering products or services through us (which are beneficiaries of this arbitration agreement). There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys’ fees and costs), and must follow and enforce these Terms of Use as a court would.

Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. You may choose to have an arbitration conducted by telephone, based on written submissions, or at a location in Durham County, North Carolina.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to “Drawn to the Camino - Claims Department” at Drawn to the Camino LLC, . If we request arbitration against you, we will give you notice at the email address or street address you have provided through the site. The AAA's rules and filing instructions are available at www.adr.org or by calling 1-800-778-7879.

CLASS ACTION WAIVER

Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.

GOVERNING LAW

The Terms and Conditions of this agreement shall be governed and construed under the laws of the State of North Carolina. Any claims against Drawn to the Camino shall be brought in Durham County, North Carolina.

TOUR PARTICIPATION AGREEMENT

I, the Participant, as an enrollee on a Drawn to the Camino tour, understand and agree to the following:

  1. I understand that Drawn to the Camino LLC, their partners, and any companies acting on their behalf, along with their officers, directors, employees, agents, and authorized representatives (collectively referred herein as Drawn to the Camino) do not own or operate any entity which provides goods or services for my tour, including for example hotels; arrangements for, ownership of, or control over houses, apartments, or other lodging facilities; tour directors; airline, vessel, bus, or other transportation companies; local ground operators; visa processing services; providers or organizers of optional excursions; or food service or entertainment providers. I acknowledge that all such persons and entities are independent contractors and not employees of or employed by Drawn to the Camino. As a result, Drawn to the Camino is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party.

  1. Without limitation, Drawn to the Camino is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to: acts of God; force majeure; acts of government; acts of war or civil unrest, insurrection or revolt; strikes or other labor activities; criminal, terrorist or threatened terrorist activities of any kind; overbooking or downgrading of accommodations; structural or other defective conditions in houses, apartments, or other lodgings (or in any heating, plumbing, electrical or structural problem therein); mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely; dangers associated with or bites from animals, insects or pests; sanitation problems; food poisoning; epidemics, or the threat thereof; disease; lack of access to or quality of medical care; difficulty in evaluation in case of a medical or other emergency; or any negligent or willful act or failure to act of any third party, or for any other cause beyond the direct control of Drawn to the Camino.

  1. I agree to release Drawn to the Camino and my tour director (the Released Parties) from, and agree not to sue the Released Parties for, any and all claims, of any nature related in any manner to my participation in a Drawn to the Camino-sponsored tour, including, but not limited to, claims for negligence, breach of contract, breach of express or implied warranties, negligent or wrongful death or any statutorily based claim. I hereby unconditionally and unequivocally waive any and all claims and demands for all damages, losses, costs and expenses of any nature whatsoever (including attorney’s fees) on account of or arising out of any and all personal injury, death, bodily injury, mental anguish, emotional distress, property or other damage that I may suffer from any cause whatsoever related in any way to my participation in any Drawn to the Camino-sponsored tour. I further agree to release and hold harmless the Released Parties from any and all decisions to cancel, modify or delay the tour as a result of acts of God, war (whether declared or undeclared), terrorist activities or threats of terrorists activities, instability in a destination country, incidents of violence, public health issues or quarantine or threats of public health issues, substantial currency fluctuations, strikes, government restrictions, fire or severe weather conditions, or any other reason that makes it impossible or commercially unreasonable in the sole opinion of Drawn to the Camino to conduct the tour.

  1. I understand that travel in other nations is not similar to travel in the United States. Tours outside of the United States can involve inconvenience and risk, including, but not limited to, forces of nature, geographic and climatic conditions, different hygienic standards, infrastructure problems (including road maintenance, transportation delays and accommodation conditions), physical exertion for which I am unprepared, civil unrest, vandalism, crime, political instability and terrorism. Medical services or facilities may not be equal to standards in my home country. I am aware that medical services or facilities may not be readily available or accessible during some or all of the time that I am participating in the tour. I further understand that different parts of the world present unique health, disease, and safety concerns, and I agree to review any specific risks related to my destination by visiting the Centers for Disease Control and Prevention's Traveler's Health website at www.cdc.gov/travel and the State Department's International Travel website at www.state.gov/travel.

  1. I understand that Drawn to the Camino’s walking tours are active tours and require participants to walk for long distances and during extended periods of time. I acknowledge that I am voluntarily participating in these activities with knowledge of the dangers, delays and other problems that may arise in connection with the tour. I hereby assume all risk of bodily injury, death, emotional trauma, property damage, inconvenience and/or loss resulting from negligence or any other acts of any and all persons or entities, however caused, including, but not limited to, those risks mentioned above. It is my intention to fully assume all of the risks of travel and participation in the tour and to release Drawn to the Camino from any and all liabilities to the maximum extent permitted by law. I agree that this Release applies to and binds myself and any minor child who I am enrolling as a parent/legal guardian, along with all personal representatives, executors, heirs, and family.

  1. Drawn to the Camino shall have no responsibility for me whatsoever during self-guided walking and, while on a guided tour, during non-supervised activities or whenever I am absent from supervised tour activities.

  1. I have purchased a Land Only tour, I understand that my tour begins with my arrival at the first accommodation or transfer arranged by Drawn to the Camino on my itinerary and ends with my departure from the final accommodation arranged by Drawn to the Camino on my itinerary and does not include flights between cities.

  1. I understand that Drawn to the Camino is often required to pay suppliers well in advance of my tour date. This includes, but is not limited to, accommodations, meals, tickets, transportation, etc. I understand and agree that Drawn to the Camino reserves the right to refuse or cancel my reservation at their sole discretion. In such an event, the cancellation policy as outlined in the Terms and Conditions will apply.

  1. I agree to abide by Drawn to the Camino's regulations and follow the directions of my Tour Director and Drawn to the Camino's personnel during a guided tour. I understand and agree that Drawn to the Camino may dismiss me from the tour at any time and at my sole expense for the failure to follow such rules or directions. I understand that in the event I am dismissed from the tour for any reason, I waive the right to a refund of any part of my tour price, and that Drawn to the Camino may then send me home at my own expense. Drawn to the Camino is not responsible for arranging my transport home.

  1. I understand and agree that Drawn to the Camino may exclude me from participating in all or any part of the tour if, in Drawn to the Camino’s sole discretion, my condition renders me unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that regardless of its cause may constitute a hazard or embarrassment. In such case, Drawn to the Camino’s liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the tour. I understand that if I voluntarily decide not to participate in certain parts of the tour, no refunds will be made for those unused parts.

  1. I agree to abide by all local laws when abroad. I understand that if I abuse or disobey such laws, even unintentionally, I waive my right to a refund of any part of the tour price and Drawn to the Camino may send me home at my own expense. I also understand that should local authorities be involved, I will be subject to the laws of the country I am visiting.

  1. I understand and agree that if I become ill or incapacitated, Drawn to the Camino and its employees may take any action they deem necessary for my safety and well-being, including securing medical treatment and transporting me home at my own expense. Drawn to the Camino retains the right and has my authorization, in its sole discretion, to contact my emergency contact(s) with regard to health issues or any matter whatsoever that relates to my tour. In the event of a medical emergency, Drawn to the Camino will attempt to cause appropriate treatment to be administered, and I authorize Drawn to the Camino to do so. Drawn to the Camino, however, makes no warranty that it will be able to cause effective (or any) emergency treatment to be administered and Drawn to the Camino will not be responsible for monitoring any health care that I may necessitate. I agree that Drawn to the Camino is not liable for the adequacy or availability of any equipment or supplies that may be provided in conjunction with this tour, or for the adequacy or availability of any first aid or medical care, or the negligent provision of first aid or medical care by it or by its guides or agents, participants, or by any physician, emergency care facility or any other person.

  1. I understand and agree that Drawn to the Camino has the right to make changes in tour itineraries and departure dates and to modify transportation arrangements, including the use of substitute airlines. In the event of such changes, refunds will be given only in accordance with the provisions of the Terms and Conditions supplied.

  1. I understand that prices are subject to unforeseen surcharges or price increases due to currency, fuel, etc., which, if imposed by airlines or other suppliers, will be separately billed prior to the final payment date.

  1. I understand that it is my responsibility to secure the necessary travel documents (e.g., passport and visa[s]) for all locations on my tour (including locations visited in transit – even if I don’t leave the aircraft or airport). I understand that it is my responsibility to ensure that the name on the travel documents matches the legal name on my photo I.D. and tickets. Failure to fulfill either of these responsibilities does not constitute grounds for a refund.

  1. Drawn to the Camino is not responsible for loss of passports, airline tickets, or other documents, or for loss of or damage to luggage or any other passenger belongings. In the case of a lost paper ticket or missing a transfer booked by Drawn to the Camino on my behalf, I acknowledge that I am solely responsible for meeting the transportation provider's requirements (both logistical and financial) for ticket replacement.

  1. I understand that I will be required to pay for phone calls or incidental personal expenses that I incur during the tour, as well as any damage I cause to hotel rooms, means of transportation or other property.

  1. I represent that I understand the physical requirements, pacing, content, accommodations, and other aspects of the tour upon which I have enrolled, and that I have discussed with Drawn to the Camino any limitations that may make it difficult or impossible for me to participate in this tour as designed.

  1. I understand and agree that this Agreement and Drawn to the Camino's Terms and Conditions (available at https://drawntothecamino.com/legal/) constitute the entire agreement between Drawn to the Camino and me with reference to the subject matter herein, and I do not rely upon any promises, inducements or agreements not herein, including but not limited to any oral statements made to me by any agents or employees of Drawn to the Camino. This agreement may be amended or modified only in writing, signed by both parties. The waiver by Drawn to the Camino of any provision of this agreement shall in no way affect the remaining provisions of this agreement, and this agreement shall be interpreted as if such clause or provision were not contained herein.

  1. I understand and agree that this agreement shall be governed in all respects, and performance hereunder shall be judged, by the laws of the State of North Carolina. In the event of any claim, dispute or proceeding arising out of my relationship with Drawn to the Camino, or any claim which in contract, tort, or otherwise at law or in equity arises between me and the Released Parties, whether or not related to this agreement, all parties submit and consent to the exclusive jurisdiction and venue of the courts of the state of North Carolina.

  1. I understand and consent that Drawn to the Camino y may use any photographic, film, digital or video likeness taken of me, any of my comments while on tour, any of my photographic, film, digital or video content shared by me with Drawn to the Camino through any form for future publicity or marketing without compensation to me and to also use my contact information for future Drawn to the Camino promotions. If I want any or all documentation excluded I shall request it in writing. I have read and agreed to Drawn to the Camino's Privacy Policy (available at https://drawnbythecamino.com/privacy-terms-of-use), and I consent to Drawn to the Camino's processing of my personal data.

  1. I understand that my enrollment on tour with Drawn to the Camino is not complete until I have agreed to the Terms and Conditions and signed this Tour Participation Agreement. By agreeing to this Tour Participation Agreement and Terms and Conditions on behalf of other travelers for whom I am completing the enrollment process, I represent that I am authorized to act on behalf of such individual(s) and I acknowledge and affirm that Drawn to the Camino's reliance on my authority is reasonable. I agree to indemnify and defend Drawn to the Camino for any claims arising out of any violation of this representation.

KNOWING AND VOLUNTARY EXECUTION

You have carefully read and understand the provisions and legal consequences of this Agreement, and hereby agree to all of its conditions. You also understand that there are no exceptions to Drawn to the Camino’s cancellation and refund policies, to which you previously agreed when booking the tour, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond Drawn to the Camino’s control. You agree that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. You also acknowledge that you have been given the an opportunity to ask any and all questions that you may have, and that Drawn to the Camino has answered all questions to my satisfaction. Your signature applies to all pages of this document.

You acknowledge that in calculating the cost of the tour, Drawn to the Camino has relied on your consent to these terms and their enforce-ability. In the absence of this Release of Liability, the tour cost would have been higher or, alternatively, Drawn to the Camino would be unable to offer these services.

VALIDITY OF ELECTRONIC SIGNATURE

If signing electronically, you understand that a paper version of this agreement is available but have voluntarily chosen to sign this document electronically. By signing below and submitting this document to Drawn to the Camino by any means, you also acknowledge that you have carefully read and fully understand and agree to the contents and legal consequences of this Agreement, as well as Drawn to the Camino's Terms and Conditions, the itinerary for you specific trip, and any other Drawn to the Camino material that governs the TOUR.
